In a historic decision, the Superior Court of Justice, Warri, has ruled in favor of the Warri branch of the Nigeria Bar Association (NBA), declaring that the Internal Revenue Service of the State of Delta (DSIRS) lacks the constitutional authority to assemble obstacles for income collection.
Delivery of judgment in the lawsuit No: W/261/2023 – Oghenero Head Okoro & Anor V. Internal Income Service of the State of Delta y Anor – The Court granted all the supports requested by the claimants, effectively prohibiting the DSIRS task group to enforce the tax payments of motorized vehicles through the control points on the public roads.
The NBA Branch Warri had approached the Court to challenge the legality of the income working groups established by the DSIR to intercept vehicles on the roads under the appearance of verifying the details of the motor vehicles.
In its ruling, the court issued a perpetual court order that restricted the DSIR and their agents to deploy even more such work groups on public roads, describing practice as lacking constitutional or legal support.

Speaking about the victory, a representative of the NBA branch Warri said: “This sentence is a victory for the rule of law and the rights of the road users in the state of Delta. The court has made it clear that such practices of collection of illegal income must stop.”
The court also ordered the immediate dissolution of all DSIRS income work groups that currently operate on roads throughout the state.
The NBA Branch Warri urged the public, particularly motorists and transporters, to take note of the trial and inform any additional harassment or activity of the obstacle by dissolved working groups.
This decision is expected to have long -range implications for income application practices in the State of Delta and potentially in other states with similar configurations.
