The Federal Superior Court in Abuja has refused to grant a request that seeks to stop the leadership led by David Mark of the African Democratic Congress (ADC) awaiting the hearing of substantive lawsuit.
Judge Emeka Nwite rejected the three sentences requested in the ex-party motion presented by Mr. Nafiu-Bala Gombe, a former attacked ADC president, and transferred by his lawyer, Michael Agber.
Rather, the judge ordered Gombe, the demander of the claim, to put all the defendants in warning to show why the motion should not be granted and postpon the matter until September 15 so that the defendants show cause.
The ruling was delivered on September 4 and the true certified copy of the order made available to journalists on Thursday.
While the former president of the Senate, David Mark, is the current national president of the ADC, the former Governor of the State of Osun, Rauf Aregbesola, is the national secretary of the party.
Gombe, in the marked lawsuit: FHC/ABJ/CS/1819/2025, had sued ADC, Senator Mark, Aregbesola, the Independent National Electoral Commission (INEC) and Chief Ralph Nwosu as from 1st to 5th defendants, respectively.
In the ex -party motion dated and presented on September 2, the plaintiff requested a provisional court order that restricted the 4th defendant (INEC) to recognize the defendants of the second (brand) and the third (Aregbesola) as national president and national secretary of the accused 1st (ADC) on the slope of the hearing of the notification motion.
He also sought an intermediate mandate order that restricted the defendants of the second and third and his cohorts to parade as national president and national secretary of the first defendant, waiting for a hearing in the motion of the notification already presented and was delivered in the matter.
He sought an order that restricted the 4th defendant/ defendant to recognize or treat with the defendants 2 and third.
