Lawyers drag Tinubu, others to the Court about the Zamfara crisis

Concerned about insecurity and political crisis in Zamfara, lawyers of public interest in the country have approached a federal superior court that is in Abuja to seek an order that forces President Bola Ahmed Tinubu to declare an emergency state in the State.

The plaintiffs, Reuben Boma Esq., Okoro Nwadiegwu esq., And the incorporated trusts of One Love Foundation, are looking for an order that requires the National Assembly of the Federal Republic of Nigeria to take over the Chamber of the Assembly of the State of Zamfara in the general interest of justice, peace, democracy and good and the progress of the good people of the people Zamfara.

The defendants of the claim are the Federation of the Attorney General (AGF), the President of the Federal Republic of Nigeria, the president of the Chamber of Federal Representatives, the Attorney General of Zamfara and the governor of Zamfara.

In the marked lawsuit, FHC/ABJ/CS/1363/25, dated July 8, 2025, and presented by Goddy Uche, San, they raised four questions for the determination of the Court and also prayed to the Court for four declaratory relief.

They want the Court to determine: “If it takes into account the provisions of section 42, 92, 98, 100, 103, 305, 104 and 109 of the Constitution of the Federal Republic of Nigeria 1999 (according to amendment) and the prevailing circumstances and the result of the legislative, political and security events in the state of Zamfara and the state of Zamfara in the Chamber of the Assembly of the Assembly, an emergency state It can be diminished in circumstances.

“Whether by the Provisions of the Constitution, Eithher Expressly or by implication of its provisions, the president of the federal republic of nigeria, by proclamation public The Government and Deputy or OTherwise and Whether the Exercise of Such Powers is not containeted in section 305 (1), (2), (3) A, B, ¢ of the Constitution of the federal Republic of Nigeria 1999 according to amended in (2011)

“Whether by the Interpretation of Section 11 (4) and 305 of the Constitution of the Federal Republic of Nigeria, The Recent Security Challenges and the Imperative Legislative Crisis In The Zamfara State House of Assembly and Or Beyond, Due to Illegal Suspension of 10 Members from The Zamfara State State House of Assembly and the Ability of the State House of Assembly to Form A legal quorum and behavior legislative Business, and whether the federal house of representatives is not empowered to take over the functions of the legislative business in the Chamber of the State of Zamfara state in the best interest of public peace, justice, democracy and tranquility.

“In addition, the plaintiffs seek a joint and separate statement that, in view of the recent security challenges, the community crisis and the legislative crisis, there is a breakdown of the law and the order and the imminent danger for the State of Zamfara and the Federal Republic of Nigeria in general.

“A declaration and mandatory order of this Court that obliges the President of the Federal Republic of Nigeria A, by proclamation, published in the Federal Government Gazette as a legal instrument, to issue an emergency state with or without removal of the Governor and Deputy Office or others, and to exercise the other powers of section 305 (2), (3) A, BC of the Constitution of the Constitution of the Federal Republic of Nigeria 1999 (2011).

“A declaration that, in view of the clear and unequivocal provisions of sections 42, 92, 98, 100, 103, 104.11 and 109 of the Constitution, the Chamber of the Assembly of the State of Zamfara is not properly constituted by the illegal suspension of 10 members of the State of the Zamfara Assembly and the capacity of the State Assembly Chamber to form an illegal legislation and the conduct of the conduct.

“An order of this Honorable Court that requires the National Assembly of the Federal Republic of Nigeria to take care of the Chamber of the State of Zamfara State in the best general interest of justice, peace, democracy and for the good and progress of the people of the State of Zamfara and the Federal Republic of Nigeria”.
