The United States Supreme Court allowed Trump to advance with the elimination of more than 500,000 immigrants from Cuba, Haiti, Nicaragua and Venezuela. The decision revokes its humanitarian protection of probation.
The Court issued an unpaid order to remain a ruling from a lower court that had temporarily blocked the policy change. He did not offer an explanation for his decision.
In March, the Department of National Security (DHS) rescinded the protections previously granted under the Biden administration. Affected migrants received 30 days to leave the United States unless they had another form of legal status.
Immigrants and defense groups filed demands, arguing that the secretary of the DHS, Kristi Noem, lacked authority to revoke protections categorically. They affirmed that the law only allows case decisions. A Federal District Court agreed with this argument.
Despite that, the decision of the Supreme Court allows the administration to enforce the policy while the legal battles continue in the lower courts.
Judges Ketanji Brown Jackson and Sonia Sotomayor disagreed. Jackson, in his written opinion, strongly criticized the position of the majority.
She wrote that the Court “Subvalu[es] The devastating consequences of allowing the government to precipitate the lives and livelihoods of almost half a million non -citizens, while their legal claims are pending. ”
“Even if the government is likely to win on merits, in our legal system, success takes time,” Jackson continued. “And stay standards require a more than anticipated victory. I would have denied the government's request because its demonstration related to damage is obviously insufficient.”
Earlier this month, the Court also allowed the Trump administration to finish the temporary protected state (TPS) for around 350,000 Venezuelans. That decision eliminated deportation protections and stripped labor authorization.
Meanwhile, the Administration has imposed immigration limits to countries such as Afghanistan and Haiti. However, he recently admitted White South African refugees, a measure that caused criticism.
The administration said there was a genocide against White Afrikaner farmers in South Africa. That statement was publicly rejected by South African President Cyril Ramaphosa during a meeting with President Trump in the Oval office.
This ruling of the Supreme Court marks an important step in the broader effort of the Trump administration to remodel the United States immigration policy. Legal challenges are expected to continue.
